Mobility WheelchairWhen a person in a wheelchair or mobility scooter is drunk, does that count as drinking and driving?

It is not intended to be offensive, I'm just curios that my friend is in a wheelchair and he told me he was.

Any motorized machine be it a scooter, motorized wheelchair, motorcycle, car, etc. I believe that under the Act on motor vehicles, it still counts as driving under the influence.

It would be drinking / drunk in public.

If a motor vehicle, then yes, it can be considered a DUI. It's a bit sad, really, but I read the news of what is happening.

We have people here DWI charge when a horse drunk and I'm sure this includes a motorized scooter.
